1. Porschesydneysouth.com.au (Site) is an online service licensed to and managed by Porsche Retail Group Australia Pty Ltd (ACN 006 359 459) (Porsche or PRGA). Please read this legal notice carefully before using the Site.
2. By accessing and using the Site, you agree to be bound by the following terms of use (Terms). If you do not agree to be bound by these Terms, then Porsche does not grant you the right to use the Site and you must not use it.

Intellectual Property

3. All software and any content of the Site, including text, images, iconography, film, graphics, sound files, animation files, video files, the distinctive shapes of all Porsche models and model numbers (Porsche Content) are subject to copyright and other intellectual property protection laws in Australia and other countries, including but not limited to the Copyright Act 1968 (Cth) and through international treaties. All intellectual property rights in the Porsche Content are either owned by or licensed to Porsche.
4. In addition, the Site features various trade marks (registered or unregistered), including Porsche brands and logos (Trade Marks). All Trade Marks are either owned by or licensed to Porsche.
5. While you may view the Site and print or download a copy for your personal non-commercial use, all other use, copying, distribution or display of all or part of the Site is prohibited. The Porsche Content may not be copied for commercial use or distribution, nor may any Porsche Content be modified, published or reposted to other internet sites or mediums.
6. Porsche and other members of the Porsche Group will vigorously prosecute any unauthorised use of their intellectual property.

Access to the Site

7. Access to the Site is permitted on a temporary and limited basis for the purpose of browsing the Site and interacting with Porsche and other members of the Porsche Group. Porsche may withdraw, restrict access to some parts or all of the Site or amend the Site at any time without notice. Porsche will not be liable, if for any reason the Site is unavailable at any time or for any period.
8. The Site services are provided on an ‘as is’ and ‘as available’ basis. Any services you take from the Site are taken by you at your own risk. Your access to the Site and any services you take from the Site are dependent on your ability to connect to the Site and the availability, efficacy and integrity of the transmission networks existing between the Site and the device you use to access the Site. Porsche is not responsible for providing, or for the availability, suitability or efficiency of these transmission networks.

Product information and Prices

9. Some of the product information, illustrations and images featured on the Site are European and reflect each vehicle’s performance and features under European conditions. Any such information, illustrations and images are indicative and for guidance only. Please consult Porsche Centre Sydney South for current product information and availability in Australia.
10. Unless otherwise state, all prices specified on the Site for ‘new’ vehicles are the respective dealer’s driveaway price and include 12 months registration, 12 months compulsory third party (CTP) insurance (CTP is averaged between numerous insurers and based on a 40 year old male driver with a good driving record), dealer delivery charge, stamp duty, and other applicable statutory and administration charges. All prices shown are based on a standard specification vehicle with optional equipment selected during the configuration process, but excluding the cost of any selected accessories. The final price may vary according to individual circumstances. Prices are subject to change without notice. Some of the information presented has been sourced from third party applications and accuracy cannot be assured. 11. Any drive away price stated for a ‘used’ vehicle is an estimate only based on the vehicle being delivered in the state/territory of Porsche Centre Sydney South. The drive away price is indicative only, based on information provided by third party government authorities and may come with the balance of any registration or manufacturer warranty. Please confirm availability and final information, including price, registration and warranty with Porsche Centre Sydney South.

No warranties or representations

12. The Site contains information that is intended as general in nature and may be incomplete or inaccurate. Consequently, no reliance should be placed on any information. As accuracy cannot be assured, all information relating to vehicles should be confirmed with Porsche Centre Sydney South or Porsche Centre Melbourne. Subject to any non-excludable consumer guarantees and other consumer protection provisions set out in the Competition and Consumer Act 2010 (Cth) or similar legislation which cannot be excluded or limited by Porsche (Non-Excludable Rights), access to and any information accessible on the Site is provided without warranty of any kind, express or implied, including (but not limited to) any implied warranties of merchantability, fitness for any particular purpose, or non-infringement. Except for any Non-Excludable Rights, Porsche is not liable to you for any loss, damage, cost or expense (including without limitation consequential loss or damage, lost profits, loss of data, loss of use, damage to goodwill and loss due to delay) however caused (including negligence) which may be suffered or incurred or which may arise from or in connection with your use of the Site.

14. The Site may contain links to other websites (Linked Sites) maintained by other parties. Porsche does not have any control over the Linked Sites and accepts no responsibility for them or for any loss or damage that may arise from your use of the Linked Sites. Your use of the Linked Sites will be subject to any terms of use applicable to such Linked Site. Porsche does not endorse any material on the Linked Sites, nor is it responsible for and will not accept responsibility or liability for any cost, damage, expense or loss (whether direct or indirect) that is or may be incurred by you as a result of your use of any Linked Sites.

Cookies

15. The Site uses DoubleClick and Google Analytics, being internet advertising and analytics services provided by Google, Inc. (Google). Google uses “cookies”, which are text files placed on your computer, to help analyse how you use the Site.
16. The information generated by the cookie about your use of the Site (including your anonymous IP address) will be transmitted to and stored by Google on servers in the United States. 19. PRGA will handle your personal information in accordance with applicable privacy laws and PRGA’s Privacy Policy which is located at https://dealer.porsche.com/au/sydneysouth/en-AU and is incorporated into these Terms.

General

20. Porsche may amend these Terms from time to time at its discretion (Amendments). Amendments will be effective immediately upon their publication on the Site. Your continued use of the Site following any such Amendment will represent an agreement by you to be bound by these Terms as amended by the Amendments.
21. If any part of these Terms is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other part of these Terms will not be affected. So far as possible where any provision or part of a provision can be severed to render the remaining part valid, the provision must be interpreted accordingly.
22. These Terms are governed by and must be construed in accordance with the laws for the time being in force in the State of Victoria, Australia and you agree to submit to the non-exclusive jurisdiction of the courts and tribunals of that State.
